Step 6. Check your chances of success
Once your legal firm receives your case, the next step is to look at its chances of success, sometimes called ‘prospects’. This can be one of the most confusing parts of legal expenses insurance, so here's a simple explanation of what it is, why it's needed and what happens next.

"Prospects" means the chances of your case being successful.
Most legal expenses insurance policies will only continue to cover a case if it is more likely than not to succeed. This means there must be at least a 51% chance of success. Some policies may have different terms.
To decide this, your legal representative will look at the facts, the evidence and the law that applies to your situation.
They will talk to you to understand what has happened and how they can help. They may ask for more information or documents to help them make a decision about your case.
They will review your case and explain whether they believe it is likely to succeed, based on the information available.
If you are claiming money or compensation, they will also look at whether the other side is likely to be able to pay if you win your case.
If you are defending a claim, or your case does not involve compensation, they will assess whether your case is more likely than not to succeed.
To continue, your case must meet the requirements of your legal expenses insurance policy.
If they don’t think your case is likely to succeed, they will explain why in a clear and simple way.
The chances of your case succeeding can change as more information becomes available.

Your legal representative will keep this under review throughout your claim. If they decide that your case has less than a 51% chance of success, your policy may no longer cover the claim and funding may stop.
If their assessment changes at any stage, they will explain what has changed, why and what steps are required.
