Real cases, real protection for childcare providers

Across childcare, education and small‑business settings, legal and regulatory issues can arise suddenly. These real cases show how ARAG’s support helps customers resolve complex problems, protect their livelihoods and stay focused on the work that matters.

Statutory Notice scenario

Our customer received a Notice to cancel her childminder registration due to concerns about garden safety at her former rented home. ARAG accepted the claim and appointed solicitors the same day. Despite Ofsted rejecting initial objections, prospects of appeal were assessed at 65%. The case went to a three‑day First Tier Tribunal hearing, where ARAG’s solicitors secured a successful appeal. The cancellation did not take effect, and the insured remained registered—an outcome she was very pleased with, given how difficult these cases can be to win.

ARAG paid the legal costs of £25,122.

Legal Defence scenario

Following an accident at our customer's pre-school the Health & Safety Executive charges were brought for breaches of health and safety regulations. ARAG were advised of the claim and instructed a specialist solicitor who successfully defended the charges.

ARAG settled the solicitor’s fees of £2,350.

Tax Protection scenario

Our customer received a letter from HM Revenue & Customs (HMRC) confirming that they intended to make an enquiry into the insured’s tax return for the previous year. They contacted ARAG who passed the claim on to a tax consultant. After extensive investigation, HMRC confirmed that the tax return was in order with appropriate tax paid.
